The Town of Palm Beach is changing the way it tries to prevent panhandling.

Last month, the town council voted to repeal an ordinance banning the practice for fear that it specifically targeted the homeless, even though Town Attorney Skip Randolph tells CBS 12 that wasn't the case.

"It didn't say homeless persons, but it talked about solicitation on the public streets."

The nearby City of Lake Worth Beach was sued last year by four men who claimed its ordinance was unconstitutional.

Palm Beach on Tuesday gave unanimous approval on first vote to reword its town code to state that people should not be standing in the right of way and interrupting traffic flow.

"It doesn't isolate it to people who are soliciting funds."

Tuesday's vote is not final.
