Publix faces a lawsuit filed by the family of a grandmother and a toddler who were killed at a Palm Beach County store last year.

69-year old Litha Varone and her grandson 23-month old Sam Varone were shot to death in the produce section of a Royal Palm Beach Publix in June 2021.

55-year old Timothy Wall, who had no known connection to the victims, then turned the gun on himself.

A wrongful death lawsuit filed Wednesday by the family members claims that Publix location had over 40 criminal incidents in and around the store over a 3-year period and yet management failed to provide security.

The lawsuit seeks a jury trial for damages exceeding $30.000.
