Do Floridians have the right to smoke medical marijuana?
That question will be the subject of a trial in Tallahassee.
Orlando attorney John Morgan and the group People United for Medical Marijuana claim that a state law banning the smoking of medical marijuana violates a constitutional amendment passed by voters in 2016. A Leon County circuit judge has scheduled the non-jury proceeding for May 16th.
The state legislature banned smoking in last year's bill signed by Gov. Rick Scott, saying it isn't healthy. The law does allow for vaping, edibles, oils, sprays or tinctures.
There are eight cases against the state, ranging from smoking to how the state awards licenses for medical marijuana treatment centers.
