Boys, Ages 11 and 12, Accused of Raping 11-Year-Old Boyton Beach Girl

Two Florida boys, ages 11 and 12, are under arrest on charges of raping an 11-year-old girl.

The boys, whose names have been redacted from the report, were arrested in June, a month after the investigation began.

The girl told Boynton Beach police she was playing outside around her school's Spring Break time this year when the boys approached and asked for sex. She refused. She says they dragged her near a vacant home and raped her, but she told no one. 

She said one boy raped her again weeks later, threatening to "shoot her house up" if she told. She wrote a note to an employee at her school.

One boy told police the sex was consensual. The other admitted "a bad thing" happened before his mother stopped the interview. 

The age of sexual consent in Florida is 18. No one under the age of 16 can give consent under any circumstances, according to Florida statutes.

Because the boys are juveniles, further information about the case is limited. Prosecutors suspect both boys will be charged as juveniles.

Except in rare cases, juveniles under 14 are not prosecuted as adults in Palm Beach County unless they are accused of crimes punishable by life in prison.

A person less than 18 years of age who convicted of sexual battery against a victim younger than 12 is eligible for a life sentence under Florida law.

The state attorney has 21 days to file adult charges but can received court-ordered extensions. The exact date of the boys’ arrest was not available.
