FLORIDA - Florida lawmakers are advancing legislation that would require all insurance claim denials to be reviewed and approved by a licensed human expert, rather than relying solely on artificial intelligence.
Senate Bill 794, which recently passed through the Senate Banking and Insurance Committee, aims to prohibit insurance companies from making final decisions on claim denials based solely on automated systems.
If passed, the bill would mandate that a qualified human professional reassess any denied claim.
Supporters of the bill argue it adds an essential safeguard for consumers who may otherwise be subject to decisions made without human oversight.
Robert Norberg, an insurance expert from Arden Insurance in Lantana, told WPTV that the bill strengthens consumer rights.
“It gives another layer of protection for consumers,” Norberg said. “If your claim is denied, it has to be reviewed by a licensed individual who specializes in claims.
So from that standpoint, it’s a significant step toward consumer protection.”
According to Norberg, insurance companies currently utilize AI primarily to analyze risk and process data from previous claims and internal guidelines.
While the technology can streamline workflows and detect patterns, the concern lies in giving AI unchecked authority over critical decisions that affect policyholders' financial well-being.
“They’re pulling in data from all prior claims, handbooks, and databases,” Norberg explained. “It’s a powerful tool, but it shouldn’t replace the human element when it comes to determining coverage or claim validity.”
The legislation reflects growing concerns nationwide about the expanding role of AI in industries that directly impact consumers.
By enforcing human oversight in insurance decisions, Florida legislators hope to strike a balance between innovation and accountability.
The bill now awaits further hearings before it can proceed to a full vote in the Florida Senate.
