(Fort Pierce, Fla) - The family of an 85-year-old Fort Pierce woman who was killed by an alligator has filed a wrongful death lawsuit against Spanish Lakes Fairway Homes community.

Gloria Serge was walking her dog, Trooper, by the lake behind her home when she was snatched by a 10-foot, 700-pound gator last year.

The gator latched on to her left foot and dragged her into the water where she eventually drowned.

Attorney Gary Lesser says Gloria walked her dog in the backyard to avoid eviction.

"Spanish Lakes had a rule that homeowners must walk their pets in the backyard or at a neighboring dog park." Lesser says, "Gloria is dead because she followed the HOA's rules."

The suit also accuses Spanish Lakes of failing to use an FWC resource to have the gator removed.

Spanish Lakes has since posted warning signs and removed nuisance gators.
