Attorneys for a Florida woman accused of tossing her baby in a dumpster want her confession thrown out.
Rafaelle Sousa was arrested in May after her newborn baby girl was found alive inside a dumpster near Boca Raton.
The Palm Beach County Sheriff's Office says the woman admitted to delivering the baby, placing her in a bag and throwing that bag away, thinking the child was stillborn.
Sousa's lawyers asked a judge to suppress her confession, claiming a deputy reading her Miranda rights in Portugese skipped the portion that states anything she said be used against her in court. But a detective claims Sousa was not in custody at the time of questioning, so the Miranda rights were not necessary.
The judge wants to review the case before making a decision.
It heads back to court next month.
