Charges Dropped Against Cutler Bay Woman Accused of Molesting Teen Student

A Cutler Bay woman tangled in a love triangle with her husband and a fellow foreign exchange student sister is now in the clear.

The state attorney's office on Thursday dropped all charges against Marta San Jose, a former foreign exchange student.

San Jose was initially charged with lewd and lascivious behavior, for her alleged role in the molestation of her 14-year-old sister fellow exchange student along with her late husband, Dale Leary, in 2014.

Leary – who hosted San Jose and other teens in a foreign exchange program with his ex-wife – married San Jose two years prior to the alleged attacks.

But her attorney always stated San Jose was also a victim... brainwashed by Leary.

Her husband was also arrested, but he committed suicide shortly after he posted bond.

In July, police found Leary and his ex-wife, Claudia, in a car behind his Cutler Bay home. The pair were trying to poison themselves with carbon monoxide, police said. Leary died, but Claudia was hospitalized and later recovered.
