No Charges Filed In Davie CVS Shooting

A Grand Jury has decided to not charge a South Florida man who shot and killed a man who he met at a Davie CVS to complete the sale of an iPhone.

Matthew Berry answered an online ad posted by Andre Smith for the iPhone last fall. 

When they met at the pharmacy at University Drive and Griffin Road, there was an altercation in the parking lot, after which, Berry went into the store. 

Surveillance video shows Smith follow Berry into the store, and appear to get aggressive, and that's when Berry, who has a concealed carry permit, opened fire.

After reviewing evidence in the case, the grand jury decided not to return charges.

Davie Police say the case is closed.
