Mosquito Spraying Lawsuit Dismissed

A federal judge says "no" to Miami Beach residents trying to stop Miami-Dade County from using the controversial pesticide Naled in its aerial spraying of mosquitoes.  

The judge threw out a lawsuit on the matter Wednesday because he says there were errors in the complaint, it was brought against the wrong party, and it may be out of his jurisdiction.  The judge gave the residents who filed the complaint, Dr. Michael Hall and Cindy Mattson, 60 days to amend their complaint and suggested they seek counsel.  

The county has used Naled for decades to fight mosquitoes in mangroves and marshes, but is now being criticized for expanding the spraying into urban neighborhoods.  

The chemical is banned in several countries because of its effect on the environment, but now the American Academy of Pediatrics says it may also be harmful to children.
